Terms of use

Mountains and the sea are dangerous, and this app can be wrong. Slope angles, runout zones, avalanche terrain, surf, trails and weather here are worked out by software from public data that can be coarse, out of date or mistaken. They are not avalanche advice, a forecast or a guarantee that a route is safe or passable. Read the official avalanche bulletin and weather forecast, look at the terrain yourself, carry the right equipment, and make your own decisions. You go at your own risk.
The service
BreakTrail is run by (operator not configured: BREAKTRAIL_OPERATOR) ((contact not configured: BREAKTRAIL_CONTACT)). It's in public beta: free, offered as it is, and it may change, break, lose features or stop. These terms apply when you use it; by creating an account you accept them.
It's free while it's a beta. It will likely become a paid service after it. Before anything costs money you'll be told by email, with time to decide, and nothing is ever charged without you choosing a plan. If you don't, you keep the right to download everything you saved and delete your account.
Your account
- You must be at least 16.
- Accounts are by invitation, and the beta may have a limited number of places. You may invite a few others with your own links; don't sell them or post them publicly. Keep your password to yourself; you're responsible for what's done with your account.
- You can delete your account at any time (More › Account). We may suspend or delete an account that breaks these terms, and will say why when we can.
What you put in
- What you save and publish stays yours. You give the operator the right to store it, show it to you and, for what you publish (condition reports, public routes), to the other users of BreakTrail, for as long as it's there.
- Only publish what you have the right to, and nothing illegal, hateful, misleading or someone else's personal data. Don't publish a route through private land or a closed area as if it were open.
- The operator may remove published content that breaks these terms.
Pro topos
- Pro topos are guidebook entries other users of BreakTrail sell here: a tour, or every tour of a seller's in an area. The seller wrote it and answers for it; the operator sells it for them and doesn't check it in the field. Like any guidebook it can be wrong or out of date, and conditions change: the warning at the top of this page holds for it too.
- What you buy is the right to read and use it yourself, for your own trips, on any device you log in on: on the web and in the apps. It isn't yours to republish, share, sell or hand on.
- It's delivered at once. By buying you ask for that, and you accept that the 14-day right to cancel a distance purchase ends once it's yours, as EU law allows for digital content.
- Something wrong with one (it isn't what it says, it's dangerous, it's copied from somewhere): report it from its card. Paid by card, ask ((contact not configured: BREAKTRAIL_CONTACT)) within 30 days and you get your money back if it's fair. Bought in an app, refunds are the App Store's or Google Play's to give; a refund there takes the topo away here too.
- What you bought stays yours if the seller takes it off sale, deletes it, or leaves BreakTrail. If BreakTrail itself shuts down, you'll have time to save what you bought to your Library and export it.
- Selling one has terms of its own: the seller terms.
Fair use
- Use the app as a person would. Don't scrape it, bulk-download tiles or data, get round its limits, probe it for weaknesses without permission, or use it to build a competing data set.
- Much of what you see is someone else's data under its own licence, listed with its credit on Sources. Downloading a GPX or saving an area offline is for your own trips; republishing data from here is subject to those licences.
Liability
The service is provided without any warranty. To the extent the law allows, the operator isn't liable for any loss, injury or damage from using it or relying on what it shows, or from it being unavailable or losing data. Nothing here limits liability that can't be limited by law, such as for gross negligence or wilful misconduct, or your rights as a consumer.
Privacy
How your data is handled is in the privacy notice.
Changes and law
If these terms change in a way that matters, the app asks you to accept them again. They're governed by the law of Sweden, without taking away the protection of the law where you live.
